How is FLSA overtime calculated in the US?
Under the Fair Labor Standards Act (FLSA), covered non-exempt employees must receive overtime pay for hours worked over 40 in a workweek at a rate not less than 1.5 times their regular rate of pay.
Does California have daily overtime rules?
Yes. In California, non-exempt employees earn 1.5x overtime for hours worked beyond 8 up to 12 in a single workday, and 2.0x double-time pay for hours worked beyond 12 in a single workday.
Are lunch breaks paid or unpaid?
Bona fide meal periods (typically 30 minutes or longer) where the employee is completely relieved from duty are not considered work time and are unpaid.
